
TERMS AND CONDITIONS
By registering via our websites, completing and signing a registration form, confirming a quotation in writing or verbally and/or purchasing one of our products, you are entering into an agreement with Skateschool Leeuwarden.
The following terms and conditions apply to this agreement.
Article 1. Liability
Unless it is demonstrated by the person concerned that the damage was caused by actions by or on behalf of Skateschool Leeuwarden that seriously conflict with the care that must be exercised in the context of Skateschool Leeuwarden's capacity as an activity organizer, Skateschool Leeuwarden is not liable for theft, accidents or damage that takes place at the locations and/or accommodations where Skateschool Leeuwarden carries out its activities or organizes activities. Skateschool Leeuwarden is also not liable for damage caused during or as a result of attending an activity.
Skateschool Leeuwarden is not liable for damage that has arisen as a result of non-compliance by the person concerned with safety regulations, or non-compliance with the instructions of Skateschool Leeuwarden and/or its supervisors.
For defects with regard to (additional) services by Skateschool Leeuwarden, the liability of Skateschool Leeuwarden is limited to a maximum amount equal to the registration fee of the activity concerned. This limitation does not apply if the damage is due to intent or gross negligence on the part of Skateschool Leeuwarden or its supervisors.
Any liability of Skateschool Leeuwarden or of its supervisors, employees and volunteers is at all times limited to the amount that is paid out in the relevant case under the liability insurer of Skateschool Leeuwarden, including the amount of the deductible. The following restrictions must be observed:
Consequential damage, trading loss and loss of profit, regardless of the cause, are not eligible for compensation. If desired, the person concerned will have to insure himself against such damage.
Skateschool Leeuwarden is not liable for damage (of any kind) caused by or during the execution of the agreement to property (including movable and immovable property) either with the person concerned or with third parties.
Article 2. Registration/confirmation and cancellation/cancellation
The purchase of a product or the registration/confirmation takes place for the period in which the activity takes place. By purchasing, registration/confirmation you are obliged to pay the full registration fee for the activity in question.
Any termination/cancellation must be made no later than 24 hours before the start of the activity concerned. Unless otherwise stated.
In all cases, cancellation must be made by e-mail. If cancellation is not done in time or in writing, Skateschool Leeuwarden has the right to charge you the registration fee for the activity in question.Activities that are canceled due to illness of the supervisors, or for other reasons that lie outside the participant/client, will be replaced as much as possible. Exceptions to this are unforeseen circumstances such as disasters, wars, pandemics and all other unforeseen circumstances that are beyond the control of Skateschool Leeuwarden.
In the event of premature termination, the registration fee for the entire activity is nevertheless due. Only in cases of long-term illness or injury of the participant for which a doctor's statement is provided to Skateschool Leeuwarden, it is possible to deviate from this.
In the case of a request for a birthday party, clinic or other group activity, the applicant agrees to these Terms and Conditions for all participants.
If Skateschool Leeuwarden decides to cancel an activity due to too few participants, Skateschool Leeuwarden will refund the registration fee already paid for the canceled activity.
Skateschool Leeuwarden reserves the right to cancel an activity if there are too few participants. For each activity it will be indicated what the minimum number of participants is for the activity concerned. The minimum number of participants for a regular class is 6.
Article 3. Participant's health
By registering for, or applying for, activities of Skateschool Leeuwarden, the participant/applicant declares to be completely healthy both physically and mentally and to be able to practice action sports such as skateboarding in a responsible manner.
In addition, the participant/applicant declares that if there is important information regarding the physical and/or mental health of the participant or of the participants, he or she will indicate this on the registration/application form.
In the case of an application for groups, the applicant is obliged to report details about the health of individual participants to Skateschool Leeuwarden.
Skateschool Leeuwarden reserves the right to refuse participant(s) / applicant(s) for activities if they are not completely physically and/or mentally healthy. Skateschool Leeuwarden will handle each request individually.
Article 4. Risk acceptance
The participant/applicant is aware of and accepts the risk inherent in practicing action sports. This risk can manifest itself before, during and after attending an activity and can have consequences for the health or physical condition of the participant.
The participant(s)/applicant(s) participate in the instruction at their own expense and risk.
Article 5. Insurance
Every participant/applicant must have insurance for legal liability. Skateschool Leeuwarden also advises to take out accident insurance.
Willfully caused damage to equipment, materials or persons will be recovered from the person responsible.
Regardless of the fact that Skateschool Leeuwarden takes as many measures as possible to prevent theft, each participant bears the risk of losing his or her clothing, jewelry and the like. Skateschool Leeuwarden will report the theft in the event of theft.
Article 6. Permission for photos and other image recordings
Creating visuals is inherent to skateboarding. Trucking of participants and the atmosphere around skateboarding are often captured on photo and/or film. These images are then used, for example, for a video report of the day which can be viewed on our website or social media channels.
Entering into this agreement with Skateschool Leeuwarden also means that you give permission for the taking of photos and/or other image recordings during activities on which you or your participants are shown.
This permission also means that the relevant photos and/or other images may be used by Skateschool Leeuwarden for promotional purposes.
If you do not agree with this part of the general terms and conditions, you can indicate this in some cases on the registration form. In all other cases you can inform us in writing before the start of the activity. We will then not make any recordings of you or your participants.
Article 8. Wearing protective clothing
Practicing skateboarding carries certain risks. To reduce these risks, there is protective clothing such as knee, elbow and wrist guards and a helmet. However, in practice we see that some skateboarders choose not to wear this protective clothing. They feel hindered rather than protected. To meet both safety and culture, Skateschool Leeuwarden therefore applies the following rule:
PROTECTION is recommended at all times but is not mandatory.
We understand that skating with protection can sometimes be prohibitive, but that does not alter the fact that this does not entail risks.
Skating without protection is at your own risk!
PAY ATTENTION
If you choose not to wear protective clothing during a supervised activity of Skateschool Leeuwarden, you can under no circumstances claim the liability insurance of Skateschool Leeuwarden.
